| These terms of use (the “Terms”) govern your access to and use of the Gemma family of models and derivatives (“Gemma Materials”) made available by Google LLC (“Google”). | |
| By using the Gemma Materials, you agree to these Terms. | |
| 1. License | |
| Subject to your compliance with these Terms, Google grants you a non-exclusive, worldwide, non-transferable, non-sublicensable, revocable, royalty-free copyright license to reproduce, distribute, and create derivative works of the Gemma Materials. | |
| 2. Acceptable Use Restrictions | |
| You may not use the Gemma Materials: | |
| a. To engage in or promote harmful or illegal activities, including but not limited to generating content that is illegal, harmful, or fraudulent. | |
| b. To mislead any person that the output of the Gemma Materials was human-generated when it was not. | |
| c. To violate applicable privacy, data protection, or cybersecurity laws. | |
| d. To use the Gemma Materials in any manner that competes with Google, including using output of Gemma Materials to improve any other large language model or foundational model. | |
| 3. Additional Requirements for Distribution | |
| If you distribute or make the Gemma Materials, or any derivative works, available to third parties: | |
| a. You must include these Terms with the distributed Gemma Materials. | |
| b. You must require the third parties to agree to terms that are at least as protective of the Gemma Materials as these Terms. | |
| c. You must not remove or alter any proprietary notices. | |
| 4. Trademarks | |
| These Terms do not grant any rights to use Google’s trademarks, trade names, service marks, or logos. | |
| 5. No Warranty | |
| GEMMA MATERIALS ARE PROVIDED “AS IS,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. | |
| 6. Limitation of Liability | |
| TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER GOOGLE NOR ITS AFFILIATES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. | |
| 7. Termination | |
| If you breach these Terms, your rights under these Terms will automatically terminate. Upon termination, you will stop using the Gemma Materials and destroy all copies in your possession. | |
| 8. Governing Law | |
| These Terms will be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. | |
| 9. Updates to These Terms | |
| Google may update these Terms from time to time. Your continued use of the Gemma Materials following any update will constitute acceptance of such changes. | |
| By using the Gemma Materials, you agree that you have read, understand, and agree to be bound by these Terms. | |
